İYS and KVKK
İYS consent and the KVKK privacy notice for outbound calls, how consent is stored in the CRM, and handling "don't call me".
3 min read
The assistant's outbound calls are commercial communications made on behalf of your office. In Turkey, such calls require the person's consent on İYS (İleti Yönetim Sistemi, the Commercial Electronic Message Management System) and a KVKK privacy notice (KVKK is Turkey's personal data protection law) explaining how their data is used. This article explains how Squaremeters follows these rules and which steps are your responsibility.
Heads up
This article isn't legal advice. For matters specific to your office (existing-customer exemptions, business buyers, the content of your privacy notice, retention periods), consult your legal advisor or KVKK specialist.
The basic rules
- No commercial calls without consent. In outbound campaigns the assistant only calls contacts with call consent on İYS.
- A KVKK notice must have been given. The person should know why their data is processed and that they may be called. This is usually done on the lead form, on your website or at first contact.
- Calls only within set hours. Campaigns run during the hours set at onboarding (e.g. weekdays 09:00–20:00); no calls start outside them.
- The assistant introduces itself. On every outbound call it says it's the office's assistant and why it's calling.
- "Don't call me" is handled immediately. If someone says they don't want to be called, they're removed from the call list.
Inbound calls, where the person calls your office themselves, don't need İYS consent. Your KVKK obligations still apply to the data collected during the call.
Where consent is stored in the CRM
- Open the contact in Contacts. In the Consent custom field group you'll see the status of İYS call and message consent, the consent date and source, and how the KVKK notice was given.
- The DND (Do Not Disturb) section shows which channels the person doesn't want to be contacted on. No campaign runs on a channel with DND on.
Our team sets up the consent fields and the İYS sync during onboarding. How consent is collected is your office's responsibility.
What the assistant checks before calling
For every contact in a campaign list, before the call starts:
- Is İYS call consent approved?
- Is DND off for calls?
- Are we within the set hours?
- Has the retry limit for this contact not been reached?
If any answer is "no", the contact isn't called and a note is logged in the campaign record.
"Don't call me"
Elif: Hello Can, this is Elif, Atlas Emlak's assistant. We spoke last year about Beylikdüzü; are you still looking?
Can Polat: No, we've bought. Please don't call again.
Elif: Congratulations, understood. I'm removing you from our call list. Have a good day.
What was written to the CRM: DND on for calls, tag do-not-call, contact removed from the campaign, note "Has bought, doesn't want to be called".
The assistant doesn't insist or try to persuade. If the person also opts out through İYS, that's respected too.
Call recording and notice
The assistant's calls are recorded and transcribed. We recommend telling callers; the easiest way is a short note in the greeting: "…this call is recorded for quality purposes." See Greeting and persona.
When the assistant asks for personal details (budget, phone), it also says why: "So I can find you the right property…"
Your checklist
- Do your lead forms and website have a KVKK privacy notice and explicit consent / commercial message consent checkboxes?
- Are consents being registered on İYS?
- Before running a reactivation campaign on old contacts, do they have call consent?
- Is access to call recordings limited to the team members who need it? See Roles and permissions.
If you're unsure about anything, speak to your legal advisor and your Squaremeters consultant before starting a campaign.
